Here is what your creditors can and cannot do according to the law:

  • Can call you between 8 AM - 9 PM your time
  • Can contact your friends, employer, or family to determine your whereabouts (contact information). Cannot reveal to these people that you owe debts.
  • Cannot contact you after you've requested in writing that they no longer do so. After your request, they can only contact you to let you know they have given up or that they are taking further action (like getting a judgment against you).
  • Cannot harass or abuse you, which includes using threats or foul language
  • Cannot falsely represent themselves as a government or credit bureau agent
  • Can take legal action to get a judgment against you to garnish your wages
  • Cannot advertise/publish you as a delinquent debtor in any way
  • Charge only interest and fees permitted by law
